Terms of Service

Last updated: October 28, 2026

1. Acceptance of Terms

By creating an account or using Unearth, you agree to these Terms of Service. These Terms work alongside Apple's Standard End User License Agreement (EULA) — linked from Settings and on the App Store listing — which also governs your use of the app. If you do not agree, do not use the app. We may update these terms from time to time. Continued use after changes constitutes acceptance of the revised terms.

2. About Unearth

Unearth is an antiques identifier and collection ledger operated by Simena Digital LLC, a Wyoming limited liability company. It lets you photograph a piece to suggest what it is and who made it, see a rough estimate range, keep your pieces in collections, record what you paid and what you sold for, and keep a wishlist. Unearth is not a marketplace. It does not sell, buy or broker antiques or any other product, and does not facilitate any purchase, sale, or trade between users or with any third party — it is a private identification and record-keeping tool only.

3. Account Registration

You create an account using Sign in with Apple. You must provide accurate information and keep your credentials secure; you are responsible for all activity under your account. You must be at least 13 years old (16 in the EEA) to use Unearth.

4. Subscription & Payments

Unearth requires a subscription to add, edit, delete, or scan items and to add journal entries, moments, and wishlist items — there is no free tier for building your collection. Without an active subscription your collection is read-only, and you can still export it or delete your account. Purchases are billed through Apple In-App Purchase, and the exact price for each plan is shown in your local currency on the App Store subscription screen before you confirm a purchase.

5. User Content

You own the collections, items, journal entries, moments, wishlist items, and photos you create in Unearth. Your collection is cached on your device for fast, offline browsing, and synced to our servers so it's there when you sign in on another device — see our Privacy Policy for what's stored and for how long. By using Unearth, you grant us a limited license to store and process this content for the purpose of providing the service to you (syncing your collection, running AI recognition when you turn it on, and enforcing subscription entitlements).

You are responsible for the content you create. Do not use Unearth to store or share content that is illegal, harmful, or infringes on others' rights. You may delete any item from the item itself while you have an active subscription, and you may delete your entire account at any time from Settings within the app (see §11).

6. AI Recognition and Estimates

Unearth's optional scan feature uses an AI model to suggest what a piece is, who may have made it and when, and a rough estimate range, from a photo you take or choose. The full photo, including whatever is around the piece, is sent for recognition (see our Privacy Policy §3). Suggestions and estimates are informational only, may be incorrect or incomplete, and are not a substitute for your own knowledge or judgment — always check a suggestion against the piece, its marks, or your own records before saving it. You can check, change, or clear anything it fills in before saving. The feature has a daily use limit, and it may be temporarily unavailable when overall demand is high, to keep the service sustainable for everyone. You can turn it off at any time in Settings and add items manually.

Not an appraisal. An estimate is a rough, automated range. It is often wrong and tends to run high, and it is a starting point only: not an appraisal, and not for insurance, tax, legal, lending or sale decisions. Check sold listings or ask a qualified appraiser before you rely on it.

Restricted items. For restricted categories (firearms, ivory and other endangered materials, hate memorabilia, and human remains) Unearth gives no estimate and links to no sold listings. Unearth is not a marketplace and does not help you buy or sell any item.

7. Third-Party Content and Services

Unearth integrates with the following third-party services:

Each provider's own terms and privacy policy apply to those interactions. Unearth does not display third-party advertising and does not sell user data.

8. Acceptable Use

You agree not to:

9. Intellectual Property

Unearth, including its design, code, features, and branding, is the intellectual property of Simena Digital LLC. You may not copy, modify, distribute, or create derivative works based on Unearth without our written permission.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Simena Digital LLC and its officers, employees, and agents shall not be liable for:

Unearth is provided "AS IS" without warranties of any kind, express or implied. Our total liability to you for any claims arising from or related to Unearth shall not exceed the amount you paid for the service in the 12 months preceding the claim.

11. Account Termination

You may delete your account at any time from Settings within the app. Deletion is soft-applied immediately — your active session is ended and your Apple refresh token is revoked — and finalized after 30 days. During this 30-day grace window you may restore your account by signing in again with the same Apple ID. After 30 days, your account, collections, items, journal entries, moments, wishlist, and uploaded photos are permanently and irreversibly deleted. We keep only a one-way hash of your Apple ID's user identifier, with the date of deletion and whether that Apple ID already used a trial or introductory offer, so the same Apple ID cannot receive a second one. Deleting your account does not cancel your App Store subscription; to stop being charged, cancel it in your Apple ID settings under Subscriptions.

We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive behavior, or pose a security risk to other users or the integrity of the service.

12. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of Unearth shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
